U.S. companies are also clamoring for more H1B visas to allow foreign software engineers and other skilled workers into the country.
The 65,000 visas allotted for 2007 were taken by the end of May last year, months before the end of the fiscal year in September, said Jack Krumholtz, the head of Microsoft Corp.'s government affairs office. It is also difficult to get permanent U.S. residency for foreign workers who would like to stay, he said.
"This is becoming for high-tech companies a huge retention issue," Krumholtz said. "We will start to see highly valued tech employees emigrate back to their home countries."

I have been waiting for EAD for the last 120 days. I had an info pass inquiry last month. I was told that my I- 765 and AP applications are on hold because of back ground check. Please advice can I get interim EAD from Detroit office while my application is on hold. I have info pass inquiry for next week for Interim EAD, will Detroit USCIS office help me out OR just another endless waiting time. I don?t know what to do, I have been out of work for last 4 months because of work permit. Can anybody advice me, what should I do. I have applied for I-485. Thanks

Don't panic. It will be alright you can resubmit the correct fee you have 30 days to do that. Sometimes USCIS can make mistakes even you submitted correct fee.

Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. The Vermount center seems to be having problems with their online system. I am in same boat as you, I have got the receipt for my H1 Extn but the System doesn't show up the receipt. You cannot rely on the online system or phone system to get your status update since they both share same data and both haven't been updated.

I am currently in India.
My Status:
Jobless
AP expires on August 10th 2010. Applied for AP extension since April 30th 2010. My AP extension hasn't arrived yet.
Question:
There is no way I can travel back to US before August 10th. As per what I heard, a newly issued AP cannot be used to reenter the U.S. if it was not valid as of the date of departure form the U.S. IS this correct?

Hello,
I think there is no such way to maintain H4 status legally if you shift on to EAD.
The only possible ways in your case if you shift to EAD is
i) Change the status of your wife to F1(STUDENT VISA) so that she can study or
ii) If she finds any sponsor go for H1(so that she can work).

As always thanks for all of your help who are out there and lending a hand to each other in this immigration mess.
After denial of I-140 (EB3) in November of 2007 in response to my A2P RFE, I filled for appeal in December 2007. Now my case is in appeal with AAO. My H1b is expiring in June 2008. I am hoping to get an extension based on my pending appeal.
In the meantime, another company has offered me a job and agreed to file the labor of my behalf. In the current situation of mine, where appeal is pending, which will take a long time for the final decision, my lawyer suggested to file the new labor through that company and this time under EB2 catagory. I dont have masters degree but I have BS computer science and now more than 5 years of US experience. He suggested EB2 since for my home country EB2 is always current.
I just want to get an opinion for all of you about this situation of mine, and filing labor under Eb2 cat under PERM. The position in the new company is Senior Security Analyst and requires Masters degree or 5 years of experience.
Also , what is the process of getting extension on H1b while appeal is pending and how early should I file the extension before June 2008.

Try the following:
1) Talk to your lawyer and see if contacting your local congress person would help you.
2) Post in other forums as well such as murthy.com and immigrationportal.com.
Good luck. The whole GC process is very stressful when everything is progressing without a hitch. So, I cannot imagine how much more stressful it must be when things get screwed by BEC and/or USCIS.

Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.
Please help!!
