This is a simple and straightforward case.
Rules are: You are allowed to change the company but you should be in "same or similar" position.
Your new company will have to agree to continue to support the existing green card process i.e. they may have to give employment verification letter if and when asked by USCIS..
All in all I think you are in the safe..

Thanks a lot for your prompt reply. I have not applied for 140 or 485 yet. Without applying for these there is no way we can apply for EAD right?

My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

I would suggest just show the salary and what you have in the bank in USA. That would be good enough. If you see the question....it asks for how much money you have in the US banks and not in outside banks. So you do not need to put that in this form.
Dont worry 55k + 3K is more than enough for the Affidavit of support. The amount proves that you can support your family.....

My EAD and AP application got rejected because of missing signature on the form.Now i am planning to file on my own with out the help of attorney as he is charging me too much for refile.
So needed help in drafting the letter addressing the situation.Above all i didn't receive my application back and USCIS personnel told me that i can refile as a fresh application if i don't receive in 30days.And i am already completed the 30days.I do have the rejected application LIN number and my 485 receipt.
Please advice me what to do i want to avoid attorney.

I called Board Protection Dept they said follow the latest date. which is Dec 05, 2009. anyone confirm?

I have an approved I-140 and have applied for the I-485 in August 2007 and got my and my wife’s EAD and AP in October 2007, which we are periodically renewing. I am the primary applicant in the GC application.
The company which sponsored my GC is a small Information Technology firm.
I am currently working fulltime with another company using my EAD. I came to know that my previous company who sponsored my green card is not doing well.
My question is:
1) What happens to my Green Card application if my GC sponsored company shutsdown or file for bankruptcy?
2) Since I am working on EAD, what will be my status, if my GC sponsored company shuts down or file for bankruptcy?
3) What happens to my GC application?

My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.
The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.
What would be my best options. Please reply ASAP

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
3. Is it necessary that immigrant visa petition (greencard) is in process before applying for K3 visa?

According to a recent Newsweek article, Immigrants irrespective of their legal status are actually good for the job market, and boost the economy.

The most skilled create jobs in technology and engineering, says Duke professor Vivek Wadhwa, who estimates that in 2005 immigrant-founded engineering and tech companies employed 450,000 people and generated $52 billion in sales. Two highly respected Australian economists, Maureen Rimmer and Peter Dixon, studied the issue for the libertarian Cato Institute. "The net impact on U.S. households from tighter border enforcement is unambiguously negative," they found, because even low-skilled immigrants expand the economic pie and create jobs farther up the ladder. In an interview on David Letterman (http://www.youtube.com/watch?v=xpvNXPPOMr8), actor Robert Downey, Jr., talked about a problem he had last year in Japan, when upon entering he was detained and questioned about his past criminal record. Downey said: I probably should have seen there was a sign that said 'No Felons Allowed' in English and Japanese and I haven't had that expunged yet," he said. "You can actually get things expunged but I've been pretty busy. So I was detained, I was interrogated. It was a blast.
Haven't you settled up? Haven't you paid your debts? Letterman asked.
Clearly I haven't paid my debts to Japan, said Downey.
While I certainly feel somewhat bad for Mr. Downey, this short exchange gave the impression that nothing similar would ever happen in America! Hah!
U.S. Immigration Law contains restrictions that bar entry to people forever, for virtually any youthful indiscretion they have ever had, e.g. simple possession of a marijuana 20 years ago, without regard to whether or not you were actually convicted of the crime! You do not even need to have been convicted; the fact that you admit you did it will also get you barred from entry. Heck you will even be bounced (http://www.markshuttleworth.com/archives/43) from the United States after overstaying your visa for one day, leaving one day late, and then trying to come back in on that visa. Or, you will be detained and returned because the officer thinks you MIGHT be working (http://addxorrol.blogspot.com/2007/07/ive-been-denied-entry-to-us-essentially.html).
So, if you were watching David Letterman and thanking your lucky stars that America is far nicer to arriving tourists than Japan--think again!
