No. You cannot unless you have a back - up of EAD.




How do I transfer to a new employer E2 (Premium Processing) and when can I apply for the new h1b (after the case is appealed or any time)?

There is no way you can transfer you H1-B as you old one has already expired. The only way left is applying for a new H1-b, according to my lawyer, the sooner the better. The new H1-b mostly will be a consulate case. Meaning, even though you are approved, it will be only activated once you go for visa stamping.

No, you can only start working once it is acitvated. Meaning, once u get it stamped if it is approved as a consulate case.

If consulate case, then you will have to get it stamp to start working.

Can i transfer my approved I140 to a new employer ?

I guess, if you have filed I-485 which is already past 180 days. (Check with ur lawyer)

Apply for GC...as you become illegal its easier to get GC. Only people who legal and law obeying to need to be in line for years.

And I can't apply for a green card, I don't meet the criteria...I'd have to get married with a woman.

I found the answer from the I-693 form. X-ray is only needed in the following situation:

Chest X-Ray - Required ONLY for TST reactions of > 5mm or if specific TST exception criteria met, or for an applicant with TB symptoms or immunosuppression (e.g., HIV). Attach copy of X-Ray Report.

So, after consulting with a good lawyer, we are filing motion to re-open for H-1B denial that I received couple of weeks ago.
Basically, it was about the client location and the iterinary at the location which was not provided efficiently for the RFE response.
I asked few questions to the new lawyer:
Am I in status now: She said that I am in legal status subject to we file a RFE within 33 days. It will take 3 to 4 months for a response.
Can I change my employer: The response was "No, I cannot change my employer as I do not have a valid H-1B status (H-1B pending is not a valid status to change employer)
Can I work: She responded that "Yes, I can work as long as the case is pending and approved".
What happens if it gets rejected again: We can appeal the case as all the documents are submitted now.

Gurus,
Did anybody face the similar issues as I am facing. If so, please throw light on it.
For the first RFE, we have not submitted any contarct with the client, ID, time cards etc.
This time I am submitting all the proof.
Did anybody get the approval after filing for MTR.

Thanks to all for their prompt reply on my situation. I am in NJ/NY area. And considering short term course during the period of Jun 2008 to October 2008. Which is almost 3 months. Any one have any idea if any kaplan center or community college provide courses or I20 in summer session?

Getting job in university and some non profit organization is another good option. If we consider that, we can apply for H1 anytime? Please advise some more in this option.

Yes marriage is another option, but only 50% is in my hand for this option.

Please please guys, get me some way out of this situation.

Oh, since my H1 has been denied, can I file for 'Motion to ReOpen'? How long USCIS take to decide on MTR and what are my chances there.

The best option for you is go back to a community college to bridge the gap. Motion to reopen will take a long time.

Any idea how do they transfer application from VSC to NSC? Process or guidelines around it would be helpful.

My para-legal told me that since my I-140 has a EAC number, my I-485 was also sent to Vermont.

Nice idea. Sometimes, bare facts are worth quite a few pictures as well. How about compiling and forwarding the following information for each of our family units?

Items can be :
Years spent in the US.
Federal and state income taxes paid during these years.
Social Security contributions made.
Dollars and hours already spent on the immigration process.
Number of U. S. Citizen kids, if any.
A concise writeup on how the applicant's skill set positively impacts the employer.

Some Qatar air flight transit through London. In that case you will need a transit visa.


If we have an AP, then do we still require a transit visa?

I am thinking of traveling by qatar airlines. I believe they dont have any transit visa requirement.

Yes. That's a little dicy for Software Developer. Maybe you work in a sepcific skill and can elaborate on that.

For me I work in a field with very specific skills and my Job title was also more specific than this. We put MS+3 and that 3 years have to be spent working in one particular area and must have acquired a set of specific skills. So the requirements for my occupation were normal and we said yes.

Unfortunately it means the 485 will also be denied.....
unless you can appeal the 1-140 which is a lengthy process.....
Hopefully luck is on your side....

again please ask your lawyer as to what the best way to go is....

You can take an infopass appt at the local office and speak to an immigration officer. I know of a similar case where the USCIS officer said that the derivative 485 application is no longer valid after divorce, and the derivative application will be denied. He sent some email to the service center asking them to deny the derivative 485. The primary 485 was still approved - I don't know what happened to the spouse's application.

In any case as long as you are the primary applicant, and spouse is a derivative applicant- your 485 application will not be affected.

hey no one checks if you really need it or not, maybe request one for MIL or whoever is more feeble. It always helps the first time. Getting in and out of planes and getting to right place at right time. (you are not charged anything for service, though some tip is always appreciated).


You and spouse will also have an easier time from the time they board to the time you meet them.

I applied I-485 and have recieved EAD in Sept, 2007. Now early next year (i.e. Jan/Feb 2008) I plan to go out of US for a year to complete an academic course. During that time, I would have to renew my EAD so that I can get back and start working. Anyone who has some experience or knowledge how this can be done from outside US... or is there a process to follow before I leave.

Also I am told that I might receive another finger printing request duirng the same time I am out of this country, any idea !!

(1) You can renew your EAD while you are outside the country (2) you should come back before your AP expires or get back with the valid visa (3) if you e-file your EAD you will get a finger printing notice, you will have to goto ASC to give your picture. Paperfiling does not trigger EAD unless your FP expires, which is usally 15 months from your last FP.

My H1B was filed with job title "RF Engineer" which comes under "Electrical Engineering" in 2004. My first 3-year term on H1 expires this year end and employer needs to file for renewal for next 3-year term.

My LC as well as 140 were applied and are approved for the position of "Electronics Engineer" which is my current position.

Essentially Electronics Engineer position is a superset of RF Engineer/Electrical Engineer positions, job duties are pretty much the same.

So now when I apply for my H1B renewal/extension does employer have to write the current position (Electronics engr) or the position on which H1B was filed first (RF engr)?

Any inputs appeciated...

That was just what I knew. For example NV does the same because they dont have state tax. They don't see a reason why they should give instate for people on temporary visas and do not pay taxes to the state. They consider us as people who are here on Non Immigrant visas who will leave any time. As you said ,TX might be more considerate.

What do you mean by PERM was done in 60 days? Do you know the login name & password of the employer. I mean the IT guy will need the login name to answer any querry else he can not pull any info.

How come there was no receipt. Was it filed at all or was rejected by the computer & you do not know that?
